Semi-Truck Accident Lawyer in Houston, TX

After a semi-truck wreck, most people focus on the driver. The driver is often the smallest part of the story. The company that put that driver on the road, the business that loaded the trailer, and whoever was paid to keep the 18-wheeler safe can each share the blame for what happened to you.

A truck accident claim works differently from an ordinary car wreck, and it starts with a harder question. Who is actually responsible?

The trucking company will not wait to answer it. Its insurer and investigators can reach the scene within hours, and the proof you need starts to vanish just as fast.

Driver logs, the truck’s onboard data, and maintenance records are often overwritten within days. Once they are gone, proving what happened gets much harder.

At LeMaster Law Firm, we step in early, name every party that may owe you, and protect the evidence while it still exists. Jennifer LeMaster built her career defending insurance companies as a partner at an international firm. Now she uses that inside view to take them on for the people who were hurt.

Why Choose LeMaster Law Firm for a Semi-Truck Accident Claim

By the time most people call for help, the carrier’s insurer has already had its own team on the case for days. The experience we bring is built for exactly that problem.

An Insurance-Defense Background Applied to Your Case

Jennifer LeMaster spent years on the other side of these claims. She served as in-house counsel for an oil and gas company, handling complex transactions and litigation, and then as a partner at an international law firm representing insurance companies. Because she used to run that side of a case, she knows how a trucking company’s investigation unfolds, where to look, and how fast to move before the key records are gone.

Direct Access and No Fee Unless You Recover

You work with our attorneys directly, not a rotating cast of case managers. We take these claims on a contingency fee, so you owe nothing up front and nothing at all unless the firm recovers compensation. Texas Super Lawyers has recognized Jennifer LeMaster every year from 2021 through 2026.

Who Can Be Held Responsible After a Semi-Truck Accident

After a serious truck crash, it is easy to assume the driver is the only one to deal with. In most semi-truck claims, responsibility can reach as many as four parties, and which ones apply to your crash decides who the claim is brought against.

Depending on what caused the wreck, any of these may share the blame:

  • The driver, for choices like speed, following distance, or pushing on when too tired to drive safely.
  • The motor carrier, meaning the company that employs or contracts the driver, for how it hired, trained, and supervised that driver and for how it kept up the truck.
  • The shipper or broker that arranged the load, when a poorly secured load or a careless choice of carrier played a part.
  • The maintenance or leasing company, when a mechanical failure traces back to its work or its equipment.

Each of those parties can carry its own insurance. Naming all of them, and not only the driver, is often the difference between a policy that barely covers your care and enough coverage to account for everything you have lost. The extra defendants are also the ones an early settlement offer can quietly leave out.

Why Semi-Truck Crashes Are Different From Car Accidents

If your injuries feel worse than you would expect from a wreck, the physics are part of the reason. A fully loaded semi can weigh up to 20 times what a passenger car does. That mismatch drives how severe the harm is to the smaller vehicle.

A loaded truck also needs far more room to stop and to turn. A small mistake behind the wheel of an 80,000-pound rig does not stay small. Broken bones, spinal injuries, and long recoveries are common results.

Size is not the only difference. These trucks have deep blind spots on every side, and a smaller car that gets rear-ended or slides under the trailer often takes the worst of a crash.

Trucks also carry a layer of rules that ordinary cars never touch. Federal regulations limit how long a driver can stay on the road and set standards for how carriers maintain their fleets and screen and train their drivers. Texas applies those same federal safety rules to carriers operating in the state, so they hold whether the crash happened on an interstate or a two-lane farm road close to home.

That extra layer can work in your favor. A gap in an hours-of-service log or a skipped inspection is not just paperwork. It can become direct proof that someone was negligent.

How Insurance and Liability Work in a Multi-Party Truck Claim

One worry tends to come up fast. Will there be enough insurance to cover a serious injury?

For most interstate trucking companies hauling general freight, federal law requires at least $750,000 in liability coverage. For certain hazardous loads, that minimum climbs to $5 million. Those are only the legal minimums, and many carriers carry more.

That can sound like a lot. Add up a hospital stay, surgeries, lost wages, and years of future care, and a serious injury can run well past it.

In a multi-party claim, more than one policy can apply. The carrier usually holds the primary commercial policy. A shipper, broker, or maintenance contractor may carry its own coverage that responds only when its negligence helped cause the crash.

An early investigation also turns up coverage that is easy to miss, like a leasing company’s policy or extra limits stacked above the primary one.

Evidence That Can Disappear After a Semi-Truck Accident

Driver is calling with his mobile phone to a car tow truck service.

The records that can prove your case often sit with the company you are up against, and most of them are not kept for long. A few pieces tend to matter most:

  • The truck’s electronic logging device and onboard engine data, which capture hours, speed, and braking.
  • The driver’s qualification file, including training, past violations, and any required drug or alcohol testing.
  • Maintenance and inspection logs that show whether a known defect went unrepaired.
  • Dashcam or forward-facing camera footage, when the truck carried one.

Carriers overwrite much of this data on a routine schedule, sometimes within days of a crash. A spoliation letter puts the company on formal notice to preserve it, and the sooner that letter goes out, the better the chance the evidence is still there when it counts. Sending it early is often one of the first moves we make on a truck case.

What a Semi-Truck Accident Claim Could Be Worth

There is no honest average for a semi-truck claim, and anyone who quotes you one before learning the facts is guessing. What a claim is worth comes down to how badly you were hurt, the care you will need, and how responsibility is divided among everyone involved. Two similar-looking crashes can settle for very different amounts for exactly those reasons.

In broad terms, a claim can account for:

  • Medical costs, both the bills already here and the care still ahead.
  • Lost income during recovery, plus any drop in what you can earn if you cannot return to the same work.
  • The physical pain and the toll the injury takes on everyday life.

Serious cases often include costs that stretch for years, like future surgeries, ongoing therapy, and income you may never fully earn back.

Your own share of fault matters too. Under Texas’s proportionate responsibility rule, a recovery is reduced by your percentage of the blame, and once your share passes more than half, it bars any recovery at all.

One deadline matters just as much. Texas generally gives you two years from the date of the crash to file a lawsuit, and once that date passes, even a strong claim is usually gone for good.

The insurance companies are already building their version of what happened, sometimes before you have left the hospital. The sooner someone is protecting your side, the more of the evidence survives and the less room the adjusters have to shape the claim around their numbers instead of your injuries.
